A contract is formed when DIGITALYSM accepts the order, normally through an order confirmation, unless a different process is clearly stated before purchase.
We may reject an order for legitimate reasons, including an obvious pricing error, unavailability, suspected fraud, or inability to fulfil the requested service.
If payment has already been collected for an order that cannot be accepted, the payment will be refunded.
4. Pricing and Payments
All prices are displayed in the currency indicated on the website or checkout page.
Applicable taxes and mandatory charges will be disclosed before purchase in accordance with applicable law.
Payments may be processed through Shopify Payments or other payment providers available at checkout.
For customised professional services, payment terms may be established separately through a proposal, invoice, or signed service agreement.
Depending on the service, payment arrangements may include:
-
Full payment in advance.
-
Deposits or milestone payments.
-
Monthly or recurring service fees.
-
Individually agreed payment schedules.
Any recurring payment obligations, billing frequency, renewal conditions, and cancellation arrangements will be disclosed before the customer agrees to them.

5. Digital Products and Downloads
Digital products may include downloadable files, templates, guides, recordings, digital resources, and other electronically delivered content.
The relevant product page will describe the content, delivery method, and any applicable technical requirements.
Digital products may be delivered through download links, email, customer accounts, or other electronic methods.
Refunds and Withdrawal Rights for Digital Products
Digital products are generally non-refundable once access or delivery has begun, subject to applicable consumer protection laws.
For consumers who have a statutory right of withdrawal, immediate delivery of digital content during the withdrawal period may result in the loss of that right only where all applicable legal requirements have been satisfied.
These requirements may include:
-
The consumer's prior express consent to begin delivery during the withdrawal period.
-
The consumer's acknowledgement that beginning delivery will result in the loss of the statutory withdrawal right.
-
The required confirmation of the contract and relevant consent.
Where these requirements have been satisfied, a customer cannot cancel the purchase merely because they changed their mind after digital delivery has begun.
This policy does not affect statutory rights relating to defective, inaccessible, or non-conforming digital content.
Customers experiencing technical problems accessing a purchased digital product should contact hello@digitalysm.com.
6. Creative Content Packages
Creative content packages may include graphics, videos, captions, advertising materials, social media assets, or other creative deliverables.
The relevant package description will specify, where applicable:
-
The number and type of deliverables.
-
The expected delivery timeframe.
-
The number of included revisions.
-
Required client materials and information.
-
Applicable usage and licensing rights.
Unless expressly stated, source files, raw footage, editable project files, third-party subscriptions, and additional revisions are not automatically included.
Content may be created or enhanced using professional editing tools, artificial intelligence technologies, licensed resources, or other production methods.
Cancellations and Refunds
Creative content packages involving customised work are treated as professional services rather than automatically as downloadable digital products.
Cancellation rights and payment obligations depend on the nature of the service, the work already performed, the agreed package conditions, and applicable law.
Where a consumer expressly requests that work begin during a statutory withdrawal period, DIGITALYSM may be entitled to proportionate payment for work already performed, subject to applicable legal requirements.
Where the relevant statutory requirements have been satisfied and a service has been fully performed, the consumer's withdrawal right may be lost.
For business customers, cancellation terms may be specified in the relevant proposal or service agreement.
7. Business & Marketing Audits
Business & Marketing Audits are professional consulting and analysis services.
An audit may include website evaluation, advertising analysis, marketing strategy assessment, customer journey review, brand positioning, business recommendations, and other agreed areas.
The specific scope, deliverables, format, and expected delivery timeframe will be stated in the applicable offer.
Audit findings represent professional assessments based on information available at the time of analysis.
DIGITALYSM does not guarantee that implementing audit recommendations will produce particular financial, advertising, or business results.
Unless expressly included, purchasing an audit does not include implementation of recommendations or ongoing marketing management.
Audit Cancellations
Cancellation and refund rights depend on whether the service has begun or been completed, the customer's legal status, and applicable consumer protection laws.
Where a consumer requests that the audit begin during a statutory withdrawal period, proportionate payment may be due for work performed if the consumer subsequently withdraws, subject to applicable law.
Where the audit has been fully performed and all statutory requirements for loss of the withdrawal right have been satisfied, the consumer may no longer have the right to withdraw.
For business customers, additional cancellation conditions may be established in the applicable offer or agreement.
8. Webinars, Workshops and Online Events
DIGITALYSM may offer live webinars, recorded sessions, online workshops, educational presentations, and training programmes.
The relevant event page will specify:
-
Event subject and description.
-
Date and time, where applicable.
-
Language and format.
-
Duration, where available.
-
Access arrangements.
-
Price and any additional conditions.
After registration and payment, where applicable, participants will receive confirmation and instructions for accessing the event.
Participants are responsible for having a suitable internet connection and compatible device.
Event Changes and Cancellations
DIGITALYSM may make reasonable changes to an event's programme, presenter, or format where necessary, provided the essential nature of the purchased service is maintained.
If DIGITALYSM cancels an event and does not provide an agreed alternative, participants will receive an appropriate refund.
If an event is rescheduled, affected participants will be informed of the available options and applicable rights.
Participant Cancellations
Cancellation and refund rights for live webinars and workshops depend on the nature of the event, the customer's status, and applicable law.
A webinar is not automatically exempt from statutory withdrawal rights solely because it is scheduled for a particular date.
Any additional cancellation or rescheduling conditions will be clearly disclosed before purchase.
For recorded webinars supplied as digital content, the digital product provisions of Section 5 may apply, subject to the relevant legal requirements.
Educational Disclaimer
Webinars, workshops, and educational materials are provided for general informational and educational purposes.
Unless expressly stated otherwise, they do not constitute individual legal, immigration, tax, financial, or other regulated professional advice.
Information may change over time, particularly regarding legislation, immigration procedures, business regulations, and government requirements.
Participants should verify current requirements with the relevant authorities or qualified professionals before making important decisions.
9. Ongoing Marketing and Management Services
Ongoing professional services may include:
-
Advertising campaign management.
-
Social media management.
-
Marketing strategy and consulting.
-
Website maintenance and optimisation.
-
Automation management.
-

-

Service Agreements
The specific scope, service period, fees, payment schedule, cancellation terms, notice periods, and termination conditions will be governed by the individual service agreement entered into between DIGITALYSM and the client.
Cancellation and Termination
Cancellation, termination, notice periods, outstanding payment obligations, and any applicable refunds will be determined by the relevant signed service agreement, subject to applicable law.
In the event of a conflict between these general Terms and a separately signed service agreement, the specific service agreement will prevail to the extent permitted by applicable law.
Nothing in these Terms excludes or limits mandatory statutory rights.
10. Custom Website, Development and Automation Projects
Custom website development, e-commerce implementation, automation solutions, and other technical projects may be subject to a separate proposal or service agreement.
The agreement may define:
-
Project scope and deliverables.
-
Technical requirements.
-
Client responsibilities.
-
Payment milestones.
-
Revision and approval procedures.
-
Delivery timelines.
-
Maintenance and support arrangements.
-
Cancellation and termination conditions.
-
Intellectual property and licensing rights.
Requests outside the agreed scope may require additional fees or a revised project timeline.
Unless expressly agreed, ongoing maintenance, third-party software subscriptions, hosting fees, and future updates are not automatically included in the original project price.
11. Consumer Withdrawal Rights
Consumers purchasing products or services remotely may have statutory withdrawal rights under applicable consumer protection legislation.
For eligible distance contracts with consumers in the European Union, a 14-day withdrawal period generally applies, subject to statutory exceptions and conditions.
The application of withdrawal rights depends on the nature of the product or service, when performance or delivery begins, and whether the applicable legal requirements have been satisfied.
For services started at the consumer's express request during the withdrawal period, proportionate payment may be due for work performed if the consumer withdraws.
For fully performed services, the withdrawal right may be lost where all applicable statutory conditions have been satisfied.
For digital content supplied without a tangible medium, the withdrawal right may be lost once supply begins if the required prior express consent, acknowledgement, and contractual confirmation have been provided.
Where a statutory withdrawal right applies, consumers may exercise it by sending a clear statement of withdrawal to hello@digitalysm.com.
Refunds will be processed within the timeframes required by applicable law.
Nothing in these Terms excludes or limits mandatory consumer rights or statutory remedies.
12. Delivery and Timelines
Estimated delivery times for products and services will be communicated through the relevant product page, proposal, or order confirmation.
Delivery schedules for customised services may depend on timely receipt of information, materials, access, and approvals from the client.
We will communicate material delays and seek appropriate solutions.
Where applicable law provides specific delivery deadlines or remedies for non-delivery, those rights remain unaffected.
13. Intellectual Property and Licensing
Unless otherwise agreed in writing, the DIGITALYSM website, branding, original content, educational materials, designs, and proprietary resources remain the intellectual property of DIGITALYSM or their respective rights holders.
Digital Products
Purchasing a digital product generally grants a limited, non-exclusive, non-transferable licence for the permitted personal or internal business use.
Unless expressly authorised, customers may not resell, redistribute, sublicense, publicly publish, or commercially exploit purchased digital materials.
Custom Creative Work
Ownership and usage rights for commissioned creative work will be determined by the relevant package description or service agreement.
Unless otherwise agreed, clients retain ownership of materials they provide and grant DIGITALYSM the permissions reasonably necessary to perform the agreed services.
Third-party assets, stock media, fonts, software, and licensed resources remain subject to their respective licence conditions.
Any transfer of intellectual property rights must be expressly agreed in writing.

Our services may involve third-party platforms, including Shopify, Google, Meta, advertising networks, social media platforms, AI tools, and other technology providers.
These platforms operate under their own terms, policies, and technical conditions.
